Wildix SMS Compliance Privacy Policy

1. Introduction

Wildix, Inc. (“Wildix,” “we,” “us,” or “our”) is committed to protecting the privacy of individuals who interact with our SMS (Short Message Service) communications. This SMS Compliance Privacy Policy (“Policy”) explains how we collect, use, disclose, and protect personal information obtained through our SMS programs. This Policy is specifically focused on SMS communications and supplements but does not replace Wildix’s general Privacy Policy.

This Policy applies to all SMS communications sent by or on behalf of Wildix, including but not limited to:
  • Appointment reminders
  • Order confirmations
  • Account updates
  • Promotional messages
  • Customer service interactions
  • Emergency notifications
  • Two-factor authentication codes

When you interact with our SMS program, we may collect the following types of information:
  • Mobile Phone Number: Your mobile phone number is essential for delivering SMS messages.
  • Message Content: We may retain the content of SMS messages you send to us and that we send to you. This is for record-keeping, quality assurance, and to address any inquiries or disputes.
  • Consent Records: We maintain records of your consent to receive SMS messages, including the date, time, and method of consent (e.g., opt-in keyword, web form submission).
  • Opt-Out Records: We maintain records of your opt-out requests.
  • Delivery Status: We track whether messages are successfully delivered.
  • Interaction Data: We may collect data about your interactions with our SMS messages, such as whether you clicked on any links included in the message (if applicable).
  • Device Information (Limited): In some cases, we may indirectly receive limited device information, such as the mobile carrier associated with your phone number. This is typically obtained through our SMS service provider.  We do NOT actively collect detailed device identifiers or location data through our SMS program.
  • Information you provide: We will collect any information that you provide via SMS.

3. How We Use Your Information

We use the information we collect through our SMS program for the following purposes:
  • Sending SMS Messages: To send you the SMS messages you have requested or consented to receive, including the types of messages listed in Scope.
  • Providing Customer Support: To respond to your inquiries, troubleshoot issues, and provide assistance related to our products and services.
  • Improving Our Services: To analyze message delivery rates, engagement, and overall program effectiveness to improve our SMS communications.
  • Compliance with Laws and Regulations: To comply with applicable laws and regulations related to SMS messaging, including the Telephone Consumer Protection Act (TCPA) and carrier guidelines.
  • Legal Requirements: To respond to lawful requests from government authorities or to protect our legal rights.
  • Internal Business Purposes: For internal business purposes related to the logging of communication.

4. Disclosure of Your Information

We may disclose your information to the following third parties:
  • SMS Service Providers: We use third-party service providers to send and manage our SMS communications. These providers have access to your mobile phone number and message content but are contractually obligated to protect your information and use it only for the purpose of providing SMS services to Wildix.
  • Legal Authorities: We may disclose your information to law enforcement, government agencies, or other third parties if required by law or legal process or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.
  • Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via SMS (if feasible) and/or a prominent notice on our website of any change in ownership or uses of your personal information.
  • Affiliates: We may share information with our affiliated companies for the purposes outlined in this policy.
  • With your consent: We may share information for any purpose with your consent.

6. Your Choices and Control (Opt‑Out)

  • Opting Out: You can opt out of receiving SMS messages from Wildix at any time by replying “STOP,” “QUIT,” “CANCEL,” “END,” or “UNSUBSCRIBE” to any of our messages. We will process your opt-out request promptly, and you will receive a confirmation message.
  • Opting Back In: If you opt out and later wish to receive SMS messages again, you will need to re-subscribe through the original opt-in method (e.g., texting the opt-in keyword, submitting a web form or sending a email).
  • Help: You can text “HELP” to receive information about our SMS program, including contact information.

7. Data Security

We take reasonable measures to protect your information from unauthorized access, use, or disclosure. These measures include:
  • Secure Storage: We store your information on secure servers with restricted access.
  • Data Encryption: We use encryption to protect your mobile phone number and message content during transmission and storage, where feasible.
  • Access Controls: Only authorized personnel have access to your information.
  • Service Provider Agreements: We have agreements with our SMS service providers that require them to maintain appropriate security measures.

8. Data Retention

We retain SMS message content and associated data for 3 years for legal and compliance purposes.

9. Children's Privacy

Our SMS program is not intended for children under the age of 18. We do not knowingly collect personal information from children through our SMS program. If you believe we have inadvertently collected information from a child, please contact us immediately.

10. Changes to this Policy

We may update this Policy from time to time. We will notify you of any material changes by sending an SMS message (if feasible) or by posting a notice on our website. Your continued use of our SMS program after the effective date of the revised Policy constitutes your acceptance of the changes.
